Workplace Accident

The plaintiff worked as a chef in a supermarket kitchen and was injured by a gas explosion in the kitchen. She had tried to turn on an oven in the supermarket kitchen when there was an explosion. She was engulfed in flames. She ran from the fire screaming and her co-workers came to her aid. Because of her injuries she was off work for four months. She suffered burns to her face, neck, ear, left hand and left forearm.

It was also claimed that she suffered from post-traumatic stress disorder because of the accident.

She sued her employer and the gas installers for the accident.

The plaintiff claimed that the defendants were negligent in the operation of the oven as when she tried to turn it on it exploded.

The defendants accepted liability. Damages were at €93,181. He accepted that the plaintiff suffered immense distress and significant pain in addition to residual scarring. He granted leave to appeal on payment of 60% of the award.
