Ex-Limerick Hurler Awarded Nearly €950,000 in Workplace Injury Case

Former Limerick senior hurler Mark Keane has been awarded €944,074 in damages following a severe workplace accident at Johnson & Johnson Vision Care (Ireland). The incident, which occurred in September 2018 at the company’s plant in the National Technological Park, Limerick, resulted in long-term injuries that have profoundly impacted his career and well-being.

The Workplace Incident

While working as a technician making contact lenses, Mr. Keane rushed to assist a colleague whose hand had become trapped in a machine. In his attempt to free the injured worker, Mr. Keane’s own right hand was caught, causing nerve damage and severe injuries to his hand, elbow, shoulder, and back. Despite his quick thinking and efforts to help, he sustained lasting physical trauma that ultimately left him unable to work.

Legal Case & High Court Ruling

Mr. Keane took legal action against Johnson & Johnson, arguing that the company had failed in its duty of care by not providing a safe work environment. His legal team, HOMS Assist, argued that the injuries caused him significant pain, PTSD, and loss of earnings, severely affecting his livelihood.

In response, Johnson & Johnson accepted liability for the nerve damage to his right hand but contested the claim regarding his shoulder injury.

After reviewing medical evidence, Mr. Justice Paul Coffey ruled in favor of Mr. Keane, awarding damages based on:

  • €135,000 for general damages (pain and suffering)

  • €408,943 for future loss of earnings

  • €154,605 for loss of earnings since the accident

  • Additional compensation for loss of pension rights, special damages, and medical costs

Impact on Mr. Keane’s Life

Once a highly skilled hurler who played for Limerick’s senior team from 2000 to 2006, Mr. Keane’s injuries have prevented him from continuing his career. The accident also had a profound emotional and psychological impact, leaving him struggling with the inability to work and provide for his family.

His wife, Karen, testified that the injuries changed him completely, leading to emotional distress and mental strain. The judge acknowledged that before the accident, Mr. Keane had overcome personal struggles, rebuilt his career, and achieved financial stability, but the workplace injury left him feeling helpless and incapable of supporting his family.
